I was recently photographed at a bar during a "sexy underwear contest" I did not sign any entry form or consent form to have my picture taken.... last week a friend showed me a "alternative lifestyle" publication with my photo in it. Is there any legal action I can take?

Did you enter an open to the public establishment? Did you participate in the activity on your own accord? If the answer both items is yes and you were not indentified by name, you have no claim.

It is my understading that your picture cannot be used as advertisment... the picture is also present with the name of the establishment... I was also told that your picture cannot be used if it was taken on private property

So sue them. Then in a few months come back and ask how to recover the $1,000 or more in legal fees that you spent for no reason when you lose your case.
