My state is South Dakota.

This is a rather complicated issue. I'm a web designer and one of my clients had a professional photographer take some photos for her. My client then bought some of these photos to use on her web site and to use in ads and flyers, which she was going to have me design.

The photographer was very upset about my client having me design the ads instead of her, even though before the photos were taken it was said that I would be designing the ads, flyers, etc. The photographer told my client that unless she (the photographer) gave her written permission my client could not use them on her web site, in ads or flyers, etc.

My question is, can she (the photographer) do this? My client paid for these photographs, shouldn't she be able to do what she wishes with them?

My client is located in Kansas and the photographer is located in Canada.

I'm not sure if I explained it very clearly, sorry if I didn't. Thanks in advance, for any help.
