My ex and I filed for divorce in 2006. Shortly after, I went on a trip with someone I began dating and, stupidly, I know, we took a couple pictures. When I returned, I had left my camera, still packed in my bag, at my house and ran some errands. In the meantime, my ex showed up at my place, went into my bag, and uploaded those couple of pictures to his palm pilot. I asked him why he wanted them as we were both dating others and in SD it's a no fault state so it wouldn't be anything he could use against me in a divorce. He had no answer. I asked for them back and he said no.

Our divorce was final in 2007. Now, I am told that some graphic pictures of myself and someone else have reared their head in a few public places. I don't live in a big city so a few places is all places. I don't know why he is doing this now, as we have both moved on along time ago, but he obtained those pictures against my will and is now using them to publicly harm me.

Is there anything out there to protect me from this or is there anything I can do? I should say that he still owes me some settlement money which is now due.

You can potentially sue your ex-husband for copyright infringement (as the photos taken by you belong to you) and invasion of privacy (publication of private matters violating ordinary decencies).

I would consult with an attorney in South Dakota to see if he/she thinks any action against your ex is worth pursuing.
