advertising right of new home

we had a new home built in virginia, after closing the builder took a picture of the home and is now using it as advertisement in various newpaper adds and home magazines for building more homes like ours. is it legal for him to do this without our permission?

Yes. He built the house didn't he?
If you feel uncomfortable, you can tell him to refrain and see what happens.
It becomes a privacy issue when he provides the address, uses your names etc.
