What is the name of your state?MD
Good morning,
I've been on medical leave since October 2017. 7/18 my aetna was terminated, I was sent a cobra (which I can't afford) application.
Yesterday I received conversion papers from met life.
I've been phoning my employer regularly to ask if all my medical paperwork was up to date & current, i.e. Fmla, supplemental doctor's statement, etc.& each time I was told yes, I'm fine.
This all sounds like I've been terminated to me. Terminated is the word used in the letters I received regarding aetna & met life, but my HR dept days I'm still in the system as active.
I literally had 1 more step to see through before returning to work. I need the services of a medical supplies company, then my doctor can fill out the paperwork for me to return to work. Without the necessary aid from the medical company, I'm not able to perform my job.
Today I was told my fmla ran out. Can I still have my doctor fill out another fmla form to submit?p
This is stressing me mentally, emotionally & I'm scared & don't know if there's anything I can do. I do like my job & I'd like to return.
Please help.

Regards

If you have been on medical leave since October of last year, your FMLA ran out in January and possibly, depending on exact dates, in December. You could quite legally have been fired at that time.

You can ask the doctor to fill out the paperwork but if you've been out of work since October I question whether you've got the minimum hours to qualify again. There's no guarantee that having him do so will protect your job.

The ADA does not require an employer to hold a job indefinitely; nor does every individual who is on medical leave qualify for ADA protection.

You might be on some form of company extended leave policy ...no clues about that . But my observation elsewhere has been if you have some sort of extension and fail to return to work able to perform your job by the end of the extension date you are gone . My personally view , if there is still a door to return ...then get yourself thru the door immediately if not sooner ....if you need to seek any accommodations....seek them after you get back aboard .

Are you employed by some unit of government which may have long term leave policies ?

Give us some idea of the medical support you need to work .
