They rented from me two months ago,they paid me first last and security,the husband is very nive but the wife is cr... let's say emmotinnaly disturbed she had argument with my wife and with all my other tenants.On august the first they paid me august rent I was very busy so I couldn't cash the check. A week the wife had came to my door and she was kikking my door and screeming so my wife called the police,and the officer told my wife to take it easy with the lady car they knew that she is emmotinaly disturbed and that she used to do the same thing where she used to live before.After that the husbund told me that he want to break the lease and that he want me to give him back the last and the security,BUT I REFUSED BECAUSE HE'S THE ONE WHO IS BREAKING THE LEASE NOT ME.
After, I posted the august rent check but it was bounced,and he told a plumber that he took his money from the bank in purpose and the plumber who work with a big local company is ready to witness.
I started the eviction
My questions are:
1- somebody told that i have to prosecute him about the bounced check how can i do that and what are my chances to get paid?
2-if i start the eviction for not paying the rent can I sue him for breaking the lease?
3-can i sue him for breaking the lease and the bounced check in the same time or will I have to do them separetely?

what do you prefer
for him to pay you all your rent and honor his lease until it expire or would it be better for all in your area if he moved

If it was me and I was having the problems you are having I would be over there helping him load the truck on moving day with a smile on my face

Well you have the last months rent (August) which will cover the bounced check....

The security is for any and all damages, plus any other lost rent in Sept. You can deduct the cost of repairs and Advertising to get the new tenants.

You can claim anything you want on the petition, it is up to the tenant IN COURT to dis-prove your claims

Of course if the tenant doesnt show up YOU WIN by default.
