From Washington state. Our new house was built near a rock quarry. We were told (do not have in writing) that we would not be bothered by the quarry and that it would be closed within a couple of years.
We now know it will be around for about 10 more years. The noises from the quarry wake us up at night, and the blasting shakes the house.
I went to the building department today and found a note on the development plat reading "This plat is located near...an active rock quarry...on which...activities may occur that are not compatible with residential development for certain periods..."
The quarry is operating within the law. Do we have any legal recourse against the developer?
