My landlord is trying to evict tenant for various breaches of lease. He (tenant) is taking it out on us by excessive noise, taking up both designated parking spaces, etc. This person filed bankruptcy right before the most recent court date and it seems that he can now stay indefinetly. In the meantime, I still have several months on my lease, or I would leave, and this person is making it miserable for us. Do you know anything about bankruptcy relative to evictions?Why do normal, law-abiding people such as tenants who pay their rent and property owners have no rights, and scabs like them(who probably planned not to pay rent) are protected?

I guess just start documenting the noise..call the police every day, make a complaint, and then see if you want to sue the landlord for a breech of the warrenty of Habitability, you have a right to a safe clean QUIET enviorment.

You could send a letter stating you intend to withold the rent untill this matter is resolved..or that you will give the landlord tillthe end of the month to resolve this, and you concider this the landlord willingness to break the lease...Take pictures of them taking both parking spaces and send it to the landlord.

The landlords only real defense is that he has a lawyer and that he has done all the legal work that is required to evict, and he has up to date with his payments to his lawyer so that the delay is in the courts...

That would be his only defense if its true, and you would be kinda out of luck till they are thrown out.

Heres the kicker.....you should ask the landlord if he is in the bankruptcy filing as a creditor, that would forestall the eviction... hey its the govermnment rules...but if he is NOT listed in the bankruptcy filing, then it cannot stop eviction..(i think)
