Hello everyone,
Here is the deal in my wonderful life of co parenting with a narc. My son went on vacation agreed dates were given, he should be retiring today February 20.2025. He is in kindergarten, has been out of school a full week previously to travel plus two weeks already more unnecessary, adding up to three weeks. His donor or I should say dad wants to and is telling me he’s staying now another two weeks that he’s not coming back!!! How the hell can he just decide to keep my son out of school for a month!! He was supposed to be back today, what do I need to file, who needs to be contacted, I have so much on his dad about being a criminal here in the us and I’m ready to show my hand of cards I want my son back home and in school, we had a passing of my grandma since he’s been gone as well. Dad won’t let me talk to my son nothing. It’s time. Please please please any advice or help I’ll be grateful for

Where are dad and your son right now? Are they in the US or Mexico?

I am not sure how helpful the US Department of State (DOS) Office is at this point but you can contact them for possible help in retrieving your child from Mexico, if the child’s father is in violation of your custody order (1-888-407-4747). Under the current administration, however, this could be more harmful than helpful because your son’s dad is not an American citizen.

A question: Was your son’s dad originally planning to return to the U.S. with your son, or was your son supposed to travel on his own? You might find the need to pick up your son in Mexico or at the border.

Yes, you're enraged. We notice that. Bet if you've talked to your husband, he's noticed too. However, he has, from what you say, not yet said he will not send your child back al all, he has just said HE's not coming back. Keep screaming, keep threatening to turn him in for all his crimes, and the idea of keeping the child may occur to him pretty soon.

If you dial it back a little bit, you may not have as big a problem as you might have had. Yes, he hasn't sent the child back. You want him now, right this instant, as per your agreement. But hiring an attorney to get the child loose and get them home is, in my opinion, a bit premature. Your husband is very likely getting away from this country because of the current political situation. But he can figure out that it will cause him lots of extra attention if he refuses to send your child home and involves himself in a big custody/parental kidnapping situation. The least notice he can get out of the country with, the less his problems may be.

Missing three week of kindergarten is not what you might call an absolute disaster. Cold but true, a five year old did not need to be deeply involved in his great-grandmother's funeral. Violating his visitation arrangements is not something you can just call up and have this man instantly declared a criminal and thrown in the pokey about. Even if he was right here in this country, that would not be the case. Neither would it work instantly if you decide to show your "hand of cards" to someone here in the United States about his alleged criminal activities.

A lot of people think all they have to do is make that call, and the person they want to turn in will be picked up and dealt with immediately. This is not the case. Right now, law enforcement is not likely to start a case where they import a Mexican to be charged in Colorado with whatever activities you say he is involved with. They're kinda busy trying to round up and export people who have already been charged with crimes.

Right now, your ex has your child. In another country. Breathe. Pull back. You might actually try talking to your husband calmly, reminding him that he must send the child back, whatever he decides to do himself. Be willing to pick him up wherever you need to. Threats, anger, hysteria, all these are not a good idea. If he really is a bad person doing bad things, he may have bad friends and associates in this country. And it could be a bit dangerous for you to be screaming at him, threatening to extradite him and telling him you'll send in the warriors. Winning this will be getting your son back safe and secure, not necessarily punishing your child's father.

You married this man or had a relationship with him and had a child with him. Now your job is to support and protect this child to the best of your ability. The law enforcement community will not be hearing of this type of situation for the first time. If you charge forward and hire an attorney, be sure that you get one who has experience in this area. Expect to pay a considerable amount.
