"Diet drink for sale. This drink will help you shed those kilos. If you do not lose 5 kilos in the first month, ABC(say) will refund your money and pay for your supermaket bills for a year."
Say one the costumers lost 2kg after 4 weeks and request for a refund and his/her supermarket bills paid for a year. What possible arguments can the company come up?
Will they pursuit this as a fraud?
Can the company consider the ad as a puff?
Is it possible that the company only need to pay only part of the money?(since the costumer does lost 2 kilos)

This sounds like a scam and not US based.

File your claim and see what happens. Then contact the consumer protection authorities in your locale and ask them. If as I suspect it is a scam, they'll never pay.
