I need to know if it is legal, in regards to skin creams, to order a product that has no patent on it and then add an active ingredient to it and repackage and sell it under our label?

All ingredients are OTC and already approved substances by the FDA and require no testing before marketing.

I need this information as soon as possible. Thank you so much for any input you can give.

You need to contact the company that makes the product and see what they have to say about it. They may not have a patent on their product but they have the right to control the sale and distribution of their product, even if it is modified from its original formula. And if your new product is going to compete with their product, what do you think the answer will be?
