My response:
From my cursory research of Texas law, I could not locate a law "requiring" someone to render aid in such a situation - - only in the event of an auto accident.
If someone chooses not to render aid, or to be a Good Samaritan, in Texas, apparently there is no criminal misconduct or civil penalty for a failure to take any affirmative action in such cases.
I certainly hope that your brother-in-law is doing better.
