What is the name of your state (only U.S. law)? Washinton State, NOT DC. My boyfriend is currently going through a divorce, and he has a 4 year old son. I recently moved him from WA to Colorado so he could go to school. We are living together. He has been seperated from his soon to be ex wife for three years. His soon to be ex wife and himself agreed upon a few things before he left the state. They would have shared custody. One year on, one year off, with visits in between. After he is done with school, the arrangement will be changed because we will be moving closer to her. The reason they are getting a divorce is because of adultery on her part. The divorce papers were filed in the May of this year. She had told him that it got thrown out in September because she didn't receive some information she needed from him. The packet he sent her was returned to us in the mail. Today he was served with a divorce packet by a federal cop that had a restraining order, and it also stated that she wanted full custody, and child support. I am seeking advise for him on what to do. There is nothing that she can bring to the table to get this, but I am worried that the court would take her side because she is the mother, and because he is in a different state. He needs to be there for any and every hearing. He also needs to file a response. Was the RO a temp order?

Um..he's also committing adultery......

Your boyfriend has willingly left his child. He needs to be aware that in WA, doing so is NOT looked upon favorably by the court.

What is your boyfriend actually wanting? What does he want to accomplish? Is it possible for him to come and register and ask the questions himself?

Yes, there certainly IS something that she can bring to the table on this. Dad moved out of state.

No judge is going to order a year on, year off schedule for any child, particularly one that young. Nor is dad going to get primary custody when he moved out of state.

Therefore dad can expect that mom will get primary custody and he will be paying child support.

It would also be exactly the same if mom had been the one to move out of state and left the child with dad. Dad would have ended up with primary custody and mom would have been the one paying child support.
