My State is Louisiana. I am in jefferson Parish, Metairie. My X from NY is trying to take custody from me because of the hurricanes. I only got a foot of water, my house is safe, and mold is out, she is going to her regular school, just made straight a's on report card. Its not her best interest to be taken out of her enviroment, when it is just getting back to normal. His allegations are either false or greatly exaggerated. For example he cites I Have no potable water, which is not true. I know its hard to have a child take away from her mom, unless mom is unfit. But what about a hurricane? I don't have lawyer. I think this would be easy for a lawyer to do, but how easy would it be for me to represent myself in this. I Can prove everything isn't right. How do I go about representing myself, and how likely is it judge will take her away? I hate to rely of myself to protect my daughters interest but I have no choice. I need help. Thanks, Marie Stein [email protected]

Which state has jurisdiction? If its NY, I think you definitely need an attorney. You are correct that you need to prove that everything is fine and you could probably do that yourself, but it simply isn't wise to fight a long distance custody battle without representation. Its too easy to make mistakes.

If jurisdiction is in LA however, then it may be safe to represent yourself without an attorney.
