My daughter lives in Massachusetts, I in New Hampshire. I drive 4hrs round trip every week for her annual 1 night sleepover, my ex - fiance however is always late, in 6 of the last 8 weeks tardiness has been 45mins to 2hrs! and lately they (ex and her boyfriend), have been doing alot of things, like spending alot of money. well turns out the money is rent money. now they are being evicted, forced by court order to pay 3 months back rent and be out of the apt. by june. they take this as a joke. they are not looking at anything but studio apts, not well suited for 2 adults and 2 children, and i have been informed by my ex that i could find my daughter who is 5, living with me until they find a place. i want her all the time if this happens or if it doesn't. the lack of respnsibility is showing further and further every week. things from my daughter outside in a city atmosphere unattended to being forced to play 20 questions when she is dropped off with her mother. they don't plan on paying any of the back rent and he is going through court for a divorce which they say they money for also. i don't know what i can do. this is really tearing me apart. i work full time and pay child support. what do i do if my child becomes homeless because of her mother lack of responsibility? how will i support us? what do i do with my job? do i have to pay child support if she lives with me? will i be fired from my job?if you could give some advice it would help me greatly. thank you

Hello your ex sounds like a compleate idiot! She is so raped up in the new guy that she is neglecting her kid. If I were you I would get custody of your daughter. And no you wouldnt have to pay child support, the mom would. If you need help getting custody and dont have the money for a lawyer then you can go to the county clerks office or to the Friend of the court and they will give you court forms. You should ask for the one called motion regarding custody. then just follow the instructions on the form.

About your job..do you work days and is your daughter in school? If so and you don't make alot of money you can go to DSS and see if you qualify to get assistance with day care. Your daughter can go there after school till you can pick her up. Find one that takes after school kids. Good Luck. Hope this helps. If you lose your job that's not right but you might be able to fight it. You can call the Dept of Labor and the attorney general' s office in your state too.

You can file for an emergency custody modification, explain what the conditions are that your child is living in. This should be enough for you to get custody as long as you can prove it to the court, especially if she is "shipped off" to live with you. Good Luck.

My husbands order si in ma. HE has an ex who jumps from place to place, noone really cares, but trust me, if she dumps that child in your lap, run for emergency custody to stop your child support, and request support from her, you may never get it, but it doesnt sound like she is in much condition to fight.

there are soo many programs out there for single parents, it wont be easy to go from being single to having a child in your house. you should explore the options (if any) at your job, (it is illegal to fire someone just because they suddenly have a child) explore your comunity for family support options,emotional and physical. if this were to come to pass.

I agree with the other posters. I would file for emergency custody, at the least. this way, at least you'll have a piece of mind knowing that your little girl is taken care of. Bio mom can barely support herself, let alone a child. she needs time to get on her feet, it seems. Not to worry about your job, as someone said, it's illegal to fire someone because they suddenly have custody of their child. also, dss could be of some help. they do offer help with daycare expenses, they have a workfirst program...lots of help for single parents. Check that out when you get the opportunity. Good luck to you, and I hope everything works out.
