Hello, I was behind on rent 1 1/2 months, (I have lived here for 10 months) I was giving her partial payments (not in writing) w/reciepts a couple times a month. At the end of july she gave me a written notice to pay the full back pay or she was going to evict me, $1050 I only had $800 so she accepted it. For the next couple of months she still accepted partial payments. I was gradually catching up. I needed help,so I put an ad in the paper. I let a couple move in for $500 a month. This was a verbal month to month agreement. (one month later) Three to Four days before rent was due, At the end of September,she personnaly collected the $500 from the new roomates, without either one of them letting me know. I was prepared to give her $1200. (I still owed $525 after I paid her $1200. Two days before I was to pay rent I received a 5 day quit or pay. I went to her and said here is $1200 and that is when she informed me that she couldn't take my money because of legal proceedings unless I had the full $1725. She told me I better start looking for a place to move to. I told her the other roomates were going to pay $500 as well. She then told me that they paid for their rent and not mine. I asked her for the owners name, (I pay rent to manager of the property I rent the condo from) and she told me he lived in Australia, and I could not reach him. She was always very secretive around other HOA board members about me renting from her.I was working for the HOA doing misc. jobs. I went out of town,and when I came back she had hired one of my roomates to take my place, because I wasn't there when she needed me. I then asked her for records of how much money she collected from the other two people living w/me and she would not do it, and said that they haven't given her any. I asked them as well and they wouldn't tell me anything except they hoped the amount they paid would go towards november rent and I would have to pay for september and october. I also had asked the manager to see a copy of the CC'Rs (covenants,conditions, and restrictions) she refused to show me and said they were only for the homeowners.
I was dumbfounded so I went to the county assessors office and found out the parcel # I lived in and the out of state owners name and his managing agents name, the address and numbers were the same, and they lived in california, not australia. I then called the number provided and a gentleman said I had the wrong number, so I double checked and it is the number and
address recorded with the county accessors office. In Arizona I believe this is against the law to not update owner and managing agent info with the assessors office.
I was late to court by 10 min. I sat down and waited until I was last, the judge assumed I was late and said to me "this is your lucky day" even though I did extensive research to prove I was wrongfully evicted. The judge had already dismissed my case. The lady who tried to evict me was in court before me and left immediately, she assumed that I was admitting guilt and that I decided to not show up.
Last of all yesterday, (if I would of lost my case) I was to be out, the land lady told the roomates I was leaving, when they asked me when I got home that night why I wasn't out, I told them the truth about winning my case, and she was lying to them. they got angry and said I was lying and slammed the bedroom door on my arm, I pushed it off and broke part of the door jamb.
They called the cops, they said I kicked in the door. I have no reason to do this, everything in this condo is mine clear the the last cup. the cops came filed a report saying I kicked in the door (when I didn't) and the next day the door jamb was completley obliterated, it was in worse condition than last night. One of the roomates said to me the manager called her attorney.Some of my personal belongings were missing from my bedroom and, the two roomates moved all of there belongings out of my condo into the HOA's office on the premisis. Now I'm afraid I'm going to need some help. What do I do. Please help, If what I read about the law in az is correct, I could be in front of the judge in 3 days from tomorrow.
