In my lease it states, "Regardless of whether it's a holiday or weekend, if you haven't paid everything that is due by the 3rd of the month (or, 3 days after the starting, as applicable), then on the 4th of the month, if it remains unpaid, we can charge you an initial late charge of $30.00.
If i pay on the 4th, shouldn't that be considered not remaining unpaid on the 4th; and therefore i shouldn't be charged the late fee?

to avoid the late fee it sounds like you should assume that you have 3 calendar days up til midnight to have rent paid and literally at 1201 am of the 4th day they might apply the late fee , since its not real clear Call your city/county hall ask if they have a renters advocate type of person or maybe the city atty or county atty office would take the time to tell you if your state has any laws about late fees for residential rental and if they would tell you what they are or arent ,If they arent able to help you call a local atty most likely since thats the only info you need the fee should be reasonable

You have a 3 day grace period..... the rent must be paid by 11:59 pm on the 3rd.

The only question is where do you pay the rent? at an office or to the landlord directly?

So lets count here 12:01 on the 1st to 1201 on the second is 1 day from 1201 the second to 1201 on the 3rd is day 2 from 1201 on the 3rd to 1201 am on the 4th is 3 FULL days!!!

NOT 9AM on the 4th!

So its YOUR JOB not to be late with the rent.

Have your rent in landlord's hands or bank by the 3rd whether it is a holiday or not. In other words, pay on the 1st.

Don't quibble over wording; don't always use the grace period--

Do what I do: Pay the rent around the 25th of the month prior. Then you don't have to worry about it. Then the one or two when you genuinely do need the grace period, your landlord is more likely to be "understanding."

I find an amicable relationship with the landlord is far preferable to the adversarial one many I talk to seem to have. Paying rent on time is helpful in fostering such a relationship.

Also....NEVER give a landlord a "post dated check". They will put them in with others which pay on time and the banks will honor them.
