Please Help Me

I have a girlfriend, she has three children, all of them have different fathers. She raises them on her own, there ages 4, 3, and 2mths. She supports them just fine, has an appartment, and a car, and all of what she needs. Her newest little boy's father is a Native American. He doesn't wish to pay costudy, so now he is filing for full custudy, she as of right now was left under the impression that there is nothing she, a white woman, can do against him. Please some one help, is this true is she really going to lose her baby, because this man....doesn't want to pay custody, he even told her just today she should have had an abortion.:mad:

By "pay custody" I assume that you mean pay child support.

Was the child born on the reservation?

Its absolutely NOT true that she, as a white woman automatically loses custody of her child if the native american father files for custody. However, if the tribe has jurisdiction it can get somewhat complicated.

Yes, I ment child support sorry, I'm young haha by age at least, back to the point. He was not born on the reservation no, do you have any suggestions for her? Any links or cases like this....anything, we are a tad desperate, she talked to child servaces and they told her that they would take her child regardless, she's a right mess over it all or she would be the one here on the forum rather than her 17 year old friend, please and thank you.

Why is social services involved and why would they tell her that they would take her child?

She called them, to ask them about the laws of this stuff, the ones the guy was telling her about. The guy from servaces told her that there was nothing she could do. :mad:

How does the guy saying there was nothing he could do equate to them taking her kids away????:confused:

And when is social services and expert on family law if neither parent is being investigated????

She needs to consult an attorney...NOT social services.

I am totally confused by what is going on here. Some things the OP is saying aren't making sense and most of that may be because she is asking for a friend and doesn't have the facts but rather a bunch of stuff that has been cobbled together third hand.

Well your right, that is the serious flaw we are lacking....facts, the very thing I came here for.

No one here can provide the facts for you. Once YOU (or your "friend") provide the facts of the situation, then people here can give you input on possible courses of action and potential outcomes.

I totally agree, but she didn't wanna call upon one because she was told it was hopeless, she would lose her baby, no matter what. But now you guys are telling me different, and as soon as I can compile some hard evidence on this, me and my family, will present her with it all, and she will hopefully then consult an attorney.

I'm not quite sure I understand, I've been telling you all I know? What is it you still require knowledge of?

The information you've provided makes no sense, as has already been stated. Really, the best thing would be for her to get online and go from there.

Hm, yes but all online information is not very reliable, not only that but we don't know where to start...maybe i should take a more direct approach to this. What can you tell me about the Indian Child Welfare Act?
