What is the name of your state? New York

I was Married to a man in Feb. of 1992. He adopted my daughter in Sept. of 1993. I left him in December of 1993. In the middle of the winter while in an apartment with my daughter, i was behind on my gas and electric bill and they were going to turn off my heat. My husband said that he would give me $1500.00 if I signed a seperation agreement stateing that he never had to pay child support and that his parental rights be terminated. I needed the money for heat, so in January of 1994 I signed the agreement. I was recently told that I could get the child support from him anyway. I filed the papers and was told that if I persued it, he would sue me for Breach Of Contract. Is that portion of the seperation legal, or should he be required to pay that child support for the child he adopted. He never did terminate his parental rights and I don't think he can. Can you please help me. His attorney said that he would take me to Supreme Court and I can't afford an attorney at this time.

So you have no Legal Court current orders ?

A contract outside of court is worthless for CS.

I suppose it could be argued that he loaned you the money to pay your utility bill , but I believe the SOL is far run out .

Child support would be ordered from the date of filing .
 
So, he adopted your child in Sept 1993 and, three months later, you left him and took the child with you? Has he had any kind of relationship with the child since the separation? Any rights of visitation?

The separation agreement you signed after he bailed you out of a financial jam was in 1994? 13 years ago?!? Are you still only separated, or was there a final divorce judgment entered?
