Please help. Slander/Perjury.

What is the name of your state? What is the name of your state? Texas.

Okay, here's the deal. I'm in college and a friend of mine (we've been friends for seven years) and I got in an argument. She took some articles of clothing of mine from my apartment and then lied about having them and refused to give them back. She threatened to burn them, etc. I have pictures of her wearing my clothes after she told me that she didn't have them. So, the day that the took them I called and asked for them back. She refused and cursed at me. I got upset and told her that'd I'd kick her ass if I didn't get my clothing back by 8pm. She called the University Police and told them that I threatened to kill her because she wouldn't come to my apartment and talk to me about my ex-boyfriend (don't know where she got that one from). She filed a report with this officer saying that I've hit her before, tried to kill her, am a heavy drug user/drinker, smoke pot and do drugs in my apartment with my roomates and friends, cut myself, and a lot of other bull**** that isn't true. None of this has any basis at all. I have never, ever touched drugs or imbibed alcohol. She does, however. She signed a legal statement saying that this is true and now it is on record with my University and she is pressing charges for Terroristic Threat. I did threaten to kick her ass, but she told the police that I threatened to gut her and kill her. Everything in the police report is completely untrue. But, this is now on my disciplinary record and I could get kicked out of school for it. Also, I think that it will remain on my record regardless, and will therefore hurt me if I try to transfer schools later. I have pictures of her drinking (she's 18), she is a compulsive liar, and has obviously poor character. Everyone that knows me knows that I am adamately against drugs and alcohol and have never touched them. Nor have I ever cut myself or hit her.

Do I have a case of slander/libel whatever.. It's on a police document so, it's written, but not published, but schools will have access to it.

What about perjury? If I can prove that everything she said in that report is a lie then what happens?

How do I go about proving that? Are witnesses testifying enough? She has absolutely no proof against me, or any witnesses for her defense.

What are my chances of winning this in court? Is it even worth my time?

Please help :)

I don't know.. I'm not sure how they're handling it. As far as I know she hasn't shown up to talk to them about it. This entire thing started Dec. 8th, when I "threatened her" and she called the police and filed that ridiculous report. I think that it was just University police though. Then, a few days later I was contacted by a University police officer, I went in and talked to him and gave him my counter statement.. But then he turned it over to the University student rights director because he never heard from the girl who filed the report and I again. He was a major dick to me. He told me that they had gotten a recording of our conversation from the phone company, (not true - they have no proof that I said anything to her except for her words - she erased the voicemail that I left and everything) and that if I didn't get him some online conversations that the threats were mutual that he was going to issue a warrant for my arrest and then "the judge was going to throw me in jail."

This entire case just seems unfair and corrupt. Apparantly this girl's mom has friends in this police department (she works for the department in the town that we're from).

But as fas as I know, her writing complete lies in her police statement about me is a big deal and she can get into some major trouble for it. There was not one word of truth in that statement.. And I think that the sole purpose for it was to taint my reputation and to get me kicked out of school (why else state drug and alcohol abuse?).

If she never goes in and talks to the University about this then I think it will get dropped. But, the records will stay on my disciplinary file - and that's a big deal. True or not, Universities are going to read that stuff. So, if I have a decent chance I'll pursue this and sue her for defamation of character and try to get her claims removed from my record. Hopefully she'll get busted for perjury as a crime against the state.

Her mom pulls a lot of stings with the police department. This girl's received 10+ speeding tickets and her mother gets them erased immediately.

I have so much dirt on this girl it's ridiculous.. And she has nothing on me - hence the need to make up complete bull about me.

i doubt anything more is going to come of this. it's almost 3 months since the incident and the university hasn't done anything.

your statement and her statement is in your file. so what. who do you think is going to see your personal file?

Q: Do I have a case of slander/libel whatever.. It's on a police document so, it's written, but not published, but schools will have access to it.

A: No; statements given to the cops, even if they are lies, are absolutely privileged.

Q: What about perjury? If I can prove that everything she said in that report is a lie then what happens?

A: You cannot be charged with perjury unless you were under oath and lied about something material.

Q: What are my chances of winning this in court?

A: Zero.
