I'm in Southern California. My son went to a local Wendys. Two girls were talking... well "crap" to eachother about a boy. the "other" girl who had propositioned the girl's boyfriend was talking to the "other" girl saying teenage bad things. The "other" girl called my son's phone he handed if off to someone else making a off handed comment that the "other" girl ended of telling her father about. It was after school not on school property. the father of the "other" girl called the school and my son got suspended. The school claims that they are trying to "keep it at the school level" and to appease the father of the "other" girl and not get police involved. My son made a remark that was not appropriate but not sincere and will follow him on his school record. It did not happen at school or during school hours. I'm concerned for his future with this on his record. Should I get a lawyer?

What exactly did your son say?

(There is, for example, a difference between "You're a skank" and "Careful we don't rape you").

(You don't have to type out swearing, either - you get the general idea :) )

Getting the truth from him... He said to stop talking to her he'd just kill her later. It sounds so bad. He's a great kid that just said a stupid thing. He has never been in a fight or has any aggressive behavior just made a stupid remark.

Yes, that was a stupid remark to make. But in this day and age it can absolutely be taken as a death threat.

My suggestion is to "wait and see" (while carrying out the appropriate punishment). If he's charged with something, you'll have a problem. If not, see what the school does.

Did this occur on his way TO school, home FROM school, or during lunch in the middle of the school day?

In any of those three circumstances, the school can often argue that they have the jurisdiction to impose administrative sanctions.

If your son was disciplined in some way, then you can check with the school and the district as to the appeals process. Typically, this involves an administrative review at the school, then at the district level, and finally - perhaps - with the school board.
