Please Help With Custody/divorce Issue

Please can someone advise me? If there is already an ongoing custody case, do I ask for custody in the divorce complaint? If I do, I'm afraid it will change judges. If I don't, I'm afraid my wife will have an edge. CAN SOMEONE PLEASE HELP? I'm looking to file the divorce tomorrow. Thanks in advance.

I would think that once a divorce is filed it might be possible to roll the custody case into the divorce case since a divorce involving children will have to address the issue of custody.

However, I'm not an attorney so I don't know if my thinking is correct. Get a consult with an attorney to see if that can be done. In the mean time I don't think it can cause harm by including in the divorce petition that you are requesting custody and include the case number for the custody case.

Make sure to make mention of the current custody case when you file for your divorce.

The situation is that my wife filed for sole legal and physical custody in July. I want to start divorce proceedings now, but I don't want to complicate the child custody case. I am contesting that of course.
