Hello, I reside in the state of Maine and have Joint Custody of my two daughters with primary residence being my home. Right now my ex gets them e/o weekend and two mornings each week. I am moving about three hours away, still in maine and my ex says he is going to take me to court to get 50% custody. I have offered him 9 days every month and 16 days for two months of his choice. If he takes me to court should I get a lawyer? He has nothing bad on me except that he is mad Im moving with my Fiance!! Thanks

My girls are 2 and 3 years old. I can understand his concern but why put the kids through all the confusion of living with two sets of rules and two daycares, plus when they do start school they would not be able to go back and forth every two weeks. My ex has known my wanting to move before we even had children and tried to put in the divorce that I could not relocate but the judge would not allow it. I guess my question is would he have a chance of getting what he wants in court? I dont think my option of 9 days and 16 days is bad considering he only sees them maybe 7 full days a month as it stands!!! Thanks

I am not familiar with Maine case law, but because the children are NOT in school yet it MAY be possible to do some sort of 50/50 physical until school age.

Also there is a REMOTE possibility because you are the one moving the children away from where they originally were when the custody was originally set, and because YOU are moving away from the NCP(thereby making it more difficult to facilitate visitation) that you may lose custody altogether. Especially if you harp on the fact he gets 7 days and that should be enough already-actually for an NCP that is quite a LOT!

what more likely may happen is you will have to offer MORE visitation, and you likely will have to cover the costs incurred.

i would at least consult with a lawyer before it goes to court.
