What is the name of your state?Pennsylvania

I was recently released from prison and have 1 Year probation and 5000 hours of community service. My probation officer will not allow me to get a job. He wants me to only do community service. I have a 7 month old daughter to care for. Is this legal? What should I do?

Probation officers are there to protect the community first and second to help aid you to the path of correction. Meaning… to offer you support and help you succeed as a person in society. Alot of probation officers are not treated well by the ex-cons that they are to counsel. So a lot of times Probation officers get too wrapped up in getting you violated so you will return to jail. It is also a well know fact that if a Probation officer does not agree with you being back on the street then he will be more likely to find creative ways of violating you Hence violating your probation.

Now, if it said in your plea agreement or sentencing that you are not to be employed then... well...??? you can’t be employed. If It states that then I doubt that the court knew that you had a child. And this is unlikly becase of the pre-sentance investigation that is ran prior to qualify you for probation. Lets just say they know where you took a dump last june in the woods when they run one of these. Even if you didn’t have a child most plea-agreements or sentencing requires the ex-con or person on probation to acquire some gainful employment. I would talk to your attorney. If you were granted the attorney by the court and do not have to pay him then if he files for a sentence modification to make sure it is written that you must seek gainful employment then your hearing wont or shouldn’t cost you anything because it is still the same case and he is still defending you. Now the re-processions of you going against your Probation officers wishes are the same as pissing off your boss. I know this is radical, but it may be in your best interest if you file for a probation transfer and move out of the county you are charged in and that way you might get a decent caring probation officer. One thing to add here is you may not be able to move if you were convicted of a crime that involved violence. It varies. Good luck with this. A classic case of holding down the man it seems LOL

Ok here is the deal. You do have to do the 5000 hours yes, but only a court can make this kind of demand Sounds like your probation officer is all wet. :eek:

**A: do that math. How the heck will you have time for a job when you have to do 5 thousand hours of community service? Are you a robot that requires no sleep?
