What is the name of your state (only U.S. law)? Washington
Hello. Let me start off by explaining that I'm not here for myself personally, but rather for someone I hold very close to my heart. I currently reside in North Dakota, while she lives in Washington (hence my reasoning for listen Washington as the state). She is currently separated from her "husband" (soon to be "ex", just haven't gone to court for it yet), living in an apartment with all the costs that go along with it (while he lives scott-free at his mother's home), works 32-38 hours a week (he works around 40 hours, as well...and has a higher income), and is splitting the time spent with their 6 year old son 50/50. She has him 3 1/2 days a week, as does he. To the best of my knowledge, they have *not* designated either one of themselves the "custodial/primary" parent...
With that being said, how is it feasibly legal, possible, and/or relevant that *he* has issued *her* with a child support decree, asking *her* to pay *him* at LEAST $400 a month in child support, and is taking her to court to "see to it" that it happens?? Can he even legally do such a thing?? He also has apparently taken it upon himself to hire a lawyer (because he can afford it, not paying any bills and having *his* mother take care of the child when it comes time for him to have him), while she cannot even begin to think about hiring one due to her being financially tapped with all the money she's required to spend on the child being that the child's father doesn't pay for anything. PLEASE HELP!! The "court date" is supposedly set for December 1st...time is something she is extremely short on. I'm doing all I can to try to help her...but I don't know what to do.
