I live in Florida and am considering bankruptcy. I have the paperwork, but am confused since much of it deals with secured debt. I have NO secured debt. I also have no assets! I have heard that sometimes it is better to do nothing and let the credit card companies write you off as "bad debt". Does anyone know anything about this? What effects will that have on future credit? ANY information on this would be so helpful! Thank you.

I filed over the net...I had a couple of questions, but for the most part. The program walked me right through everything. One paper was missing and that was because it was brand new. The site I used could not give legal advice, so I am stumped on one thing. But otherwise, it was a piece of cake. I had no assets and no secured debts either. My court date is June 25.

Hi, I live in florida as well. I am a collector for an interenational finance company. If you do nothing, the creditors can come after you at anytime. Some time down the line you may want to buy a house, etc. They can attach a lien. Also, there is the chance of garnishment. If, and it happens often, you apply for a job, they run your credit report. They will show up as as a inquiry and through that they can find out where you work & garnish.

Trust me I know, I am in charge off. That is what all your debt will do, then the creditor will do what they have to do to collect. I would file to stop any further collection activity. Good Luck ;) Sandi

Bluelvis is correct. Clean this up while you have no assets rather that letting it bite you later when things are better. I would suggest you use a lawyer. This is something you will hopefully only do once in a lifetime so it is worth paying to make sure it is done correctly. As to future credit, it'll be expensive and harder to get but, as time pases and you pay your bills on time, it'll get easier. In fact, you can qualify for an FHA mortgage 2 years after a bk discharge.

I got ALL my paperwork over the net...You input your info and print off the docs. You have to send them to your districts bankruptcy court. They give you that info also.

It costed me $139.00...$200.00 additional to file with the court. Write me at [email protected] and I will give the details. It works pretty slick.
