Hello Good day Everybody,

I have a big problem regarding visitation rights with my kids. I was deported from the united states for about 2 years now. I currently reside in Mexico, My wife will not allow me to see my kids at all. I have two boys and one girl all under the age of ten. There is no court order stating i cannot see them, Is there anything i can do from Mexico in order my kids can visit me? My brother in law is willing to bring them over the U.S. Port of Entry of Tijuana but U.S CUSTOMS will not permit entry/Exit from the U.S. unless there is a valid Approval form Signed and dated by my wife Giving Permission and allowing my brother in law to cross with them but unfortunately she refuses to provide the document due to the fact she is mad our mutual relationship came to an end therefore that is the reason i cannot see my children. What legal matter rights can i do and or have besides coming to an agreement with my wife in order to allow me to see my babys PLEASE HELP!!!!!!! :(:cry::cry::cry:

Ok, here is reality. Without a US court order, requiring her to allow visitation in Mexico, she is free to decide what she thinks is best for the children. Since you cannot come to the US due to the deportation, the odds of you being able to even mount a court case for visitation are slim. In addition, since you cannot come back to the US you are a real risk for not returning the children to the US after visitation.

Even if a judge does make an order for the children to visit you in Mexico, with the odds stacked against you, if mom refuses to obey the order there is not much you can do about it. One exception to that would be if you had enough money to hire excellent legal representation that could arrange for you to be heard via digital means, and enough that you could place a bond to ensure that mom had the money to chase you down in Mexico to legally retrieve the children.
