What is the name of your state (only U.S. law)? Illinois I would like to ask my tenant to leave. There is no leasse or security deposit. How much notice should I give him. The sooner he leaves the sooner I can stop walking on egg-shells. Thanks for the help!

Yea, that would be 30 days if he is not behind on his rent, Just like everybody else.

If he is behind on his rent, its 3 days to pay, or leave, which you then can start legal eviction.

Just like everybody else.

Its a process and although you file, it takes a bit. File paperwork in courthouse, receive a date to appear. Your case gets heard. File more paperwork for eviction. Have paperwork delivered by sherrif. It takes about 30 days for the full process to occur. Sounds like the tenant is a squatter at this point. Be patient though cause the process doesn't move as fast as we get it done people would like it to. Good luck

You can certainly give him 30 days notice and then file for eviction if he doesn't leave voluntarily but if he's been paying his rent, it will be a lot harder to get an eviction order - especially if he can demonstrate any discrimination.
