Pls help me

What is the name of your state (only U.S. law)? Virgina


Hi guys. I'm in need of some advice if you don't mind. I have a 17 yr old son who has been dating this girl who I think is 16 not sure for the past year. She told my son that she has all these medical probs and that she is dying oh and pregnant. Anyways back to the matter at hand. Yesteday I get a fone
call from an investagator saying she has my son and I need to come see her asap. When my husband and I get there we are informed that the girl is claiming my son sexualy assulted her. I gave the investagator letters that the girl wrote to my son they took his cell fone to check call logs and texts between them.

So my questions are wherebdo info from here? They did a rape kit on the girl and he is going for a polygraph next Tuesday. Do we find him a
lawyer now or wait for everything to come back. He isn't being charged at the moment.

Next question is if and I'm praying my son didn't do this because inbelieve him is there anything that can be done to her and her parents for lying? I mean lawsuit wise. I am doing this for my son so I really don't care about the money. But I will be damned if they call my son a rapist and he is found innocent. Oh forgot to tell you guys that he admitted to having sex with her that morning and didn't use a cndom because she told him she was pregnant.

Sorry if there are mad typos. I'm doing this from my iPod and the keyboard pretty much sucks.

Any advice will be very much appreciated.

Definitely get your son an attorney right away, and don't let him speak to the police without the attorney present.
 
They are actively gathering evidence with the intent of proceeding with a prosecution of your son for a sex crime if they get what they need. So far, they are doing so with your full cooperation and assistance, and I'm sure they appreciate that.

You should know that if they decide to proceed, and they may just by her word alone and a maybe a few other circumstantial things (she is a "witness" to an alleged crime, I'm not sure what other evidence you have given them), finding your son "innocent" is not going to be a part of this proceeding, even if they drop it. They are gathering probable cause now and when/if they get it, the police may show up for a warrant search of your home (especially to get your computer, search his room) and/or they could get enough to get a warrant to come arrest him and put him in Juvi pending proceedings.

This situation is not rare or unique. And, yes often girls do recant or lose interest in participating meaningfully in a prosecution (some times even if they are legitimately a victim), especially if you have a good defense attorney who will make it very uncomfortable for her - meanwhile it is conceivable your kid has been in Juvi (or expensive monitoring) for a long time, several months even, while this is going on... and/or you have spend thousands and thousands..
Or they offer you a deal you feel you must take ...
Or they convict..

You needed an attorney long ago. You have no idea has bad these things turn out for people or you would have went screaming to an attorney the first time they said "Accusing him of sexual assault".

Thank you guys so much for the advise. I'm going to talk to my mom today since she is a paralegal.
All of this went down wed and I really don't want my son to go to jail over so
something he didn't do.
As for lawsuits against them, I don't plan on doing them right away I was just wondering.

I want to thank you guys again for the advise. I have spoken to an attorney today and I was told that he is not to take the polygraph and he is not to talk to anyone including the investagator and the sherrifs office. The bad part of that is the girlfriends mom has contacted the attorneys partner and he could not give me anymore info intil he speaks to his partner. If you guys like I'd can update you on our progress and the outcome of all this mess. My mom iis going to move hell and high water to find my son an attorney since she happens to work for a bunch who unclfortunatley do not deal with these types of cases. But it pays to know attorneys who can help in any way they can.
