We moved into a 2/1 duplex in May and ever since day 1 we had sewer water backing up and coming backup into our bathtub! Property manager had a plumber here at least 3 times to unclogged the line which fix the issue temporary maybe 2-3 weeks and then backs up again. We're sick and tired of this! Plumber stated that their a broken pipe and per the property manager the owner doesn't want to fix it! We want to get out of our lease and move but the property manager stated that if we break our lease early we will have to pay full 2 months rent and we will not get our security deposit! Is their anyway we can legally break our lease and receive our deposit back?

What did your city building inspectors offices say when you called them to ask for assistance since this issue is recurring ?

Call the housing inspection agency for your area and explain the problem to them (maybe the health department as well). Raw sewage backing into the house really IS a problem and they might either force him to fix it properly or condemn the house. If they condemn it you HAVE to move out and the landlord cannot charge you anything extra or keep your deposit for doing so.
