I filed against my landlord for not returning my deposit. I lost as I went after the assoc and reg agent. I needed the actually owner.
I found my owner in Colorado, and I'm filing against him along with the Prop Mgr. I need to mention that all of this is done under the same judge.
My room mate ran off with out paying me. He left some items that I wanted to return to him and he had my property. I called his cell, sent many emails without getting any response. I finally found him, working at his new wife's plant. It took 10 months to find him. I got a judgement in my favor and I received about 3/4 of what I filed for. I asked about my property, and the judge ordered him to return via mail. I received it about 3wks later, but it had the wrong case and it doesn't work without this case.
He sent an email to pay each wk for 48wks, but it wouldn't begin until 1 month later end of Jan. In Jan I sent emails (1 every 2 wks) asking to send the correct case for my property, with no response. The checks were coming approx 1 or 2 days late. I noticed we use the same bank. I made 2 suggestions. An allotment directly to me from their account to mine or send 4 checks once a month. I gave him an address(it's a friend address), and they're moving. I sent an email with the address change, no response. When I sent the emails I'd say 'what about my case? Atleast tell me where you got it'. I sent 3 emails that wk with my changed address, and again with no response(I asked for one so I'd know they got it).
Now it's was Feb 09. I was getting no where with just asking them to replace the cover or atleast tell me 'where they got it, so I could get the correct one'. Nothing! The next email 'Ok, I guess I will have to show up and make sure that you got my address change since you will not respond'. His wife said she'd have me arrested for "stalking" if I didn't stop. I sent 1 more email -if they thought that was stalking then thanxs for the great laugh, and if that is stalking then I guess that I am stalker just trying to get what is rightfully mine. I sent a total of 8 emails in a 2 month period.
I got a notice for a hearing within 1 wk from the last email for 'stalking'. To make it short- it went in HER favor. Just because I went thru all of what I did the previous yr tracking him down without him ever responding. I said 'This is a total waste of the courts time, and my time and this needs to be thrown out-I only did what I had to, to get what was owed to me'. The judge stated that she(his wife) has enough to go to the sheriff's dept and he said he would sign the order. I guess my look was of disbelief because he then stated 'you think this is funny-I can sign one right now and send you to jail and you could have new friends there-would you like that?' I said " No sir, but what was I suppose to do about my property"-he said there is civil matters that handle the property matter. I said "Well I guess I'll just buy another case, and just take the checks when they come in". I got up and walked out as I was so disgusted-that this is our sysytem!
He is the only judge that does small claims cases. Now, I've already filed against my prop owner(who lives in Colorado) for the return of my dep and was told it may take a few months before any case is set with him living out of state. I'm afraid it will go against me in his court for this and -he(the judge) even stated when I was there the first time-that I have a good case against the building owner. What do I do? I did everything before pro se, looked up all of my info and that I could get 3x the amount back. PLEASE help as I am am so upset that he saw it that I was stalking them. I will sy -while we were waiting to go into the court room, his wife knew 3 of the 4 clerks and I'm wondering if the judge knows her also???
