POA Problem

What is the name of your state? Hawaii

My cousin currently has DPOA for my aunt. She wants him removed. She claims she has not seen her bank statements for months, credit card bills and has no idea where her money is going.

Problem; my cousin refuses to give her an accounting of her money, and pretty much keeps her in the dark. She told me she feels powerless and helpless. If I take over as POA, do I have the right to demand all accounting for the time he has handled her affairs?

Does your aunt have any dementia?

She has not been diagnosed with it. When I speak to her, she seems to be very clear in what she currently wants. Additionally, she still drives, cooks for herself and runs her own errands.

All your aunt has to do is void the POA and give that to the bank and whoever else requires the voided POA. Have your aunt see an attorney. Your aunt can go to her bank and request her bank statements and copies of cancelled checks. Also have your aunt make sure that her bank statements come to her home directly (change her address to her home) if POA has them come to him/her. If your aunt finds that her money has been mismanaged by the POA, have her call Adult Protective Services and file a police report. Your aunt can nominate the POA as executor to her estate. But, why would she want to do that given the actions of the POA?

She asked me about this a couple of months ago. I think my cousin has been trying to convince her that this would be the logical thing to do. In the meantime, she wants to change POA over to me and possibly have me as the executor. I'm not sure I want that responsibility, but I certainly don't want anyone else to take advantage of her. Thank you so much for the information, it was very helpful.
