Oklahoma...My husband's 86 yo mother sold her home and moved in with us because of declining health 2 years ago. She also gave him Durable Power of Attorney mostly for medical reasons. She paid her outstanding debts and put the remainder partly in stocks and partly in an annuity. Both were set up as payable on death to my husband, her only child. There were no other assests at the time of her death other than a small balance in her checking account. Now we find that she had received multiple "pre-approved" credit applications which she had activated. Bottom line is she left about $14,000 in credit card debt!!!! Are the PODs considered assests which we are going to have to use to pay this unsecured debt?What is the name of your state?
