Police to evict 24hrs

What is the name of your state? FL

I have a tanant who I am curretly evicting for non payment. I have done every thing through the courts and court has allowed tenant to be evicted. earlier in the week the tenant sent payment including late charges,it is a money order, I have not cashed chek b/c I know that was stop process. If I decided that I would accept the funds, how do I reverse the process. also, can I write an adendum to the lease stating that in the furture if client does not have rent in my posession by 5th of month, that I have the right to serve an eviction notice to be out within in 24 hrs. would the courts allow that. pleae let me know how it would affect any future eviction request if I stop the current?

Any modifcations you create to the lease that violate state law would be tossed out by the courts. If your tenant doesnt pay the rent again IF you allow them to stay then your going to have to start from scratch. SO if this tenants payment includes ALL related cost to this eviction then Its up to you. If the payment is short of the court related cost dont accept it

You stopping the current eviction won't change any future eviction. Won't make it longer, won't make it shorter. You can add anything you want to the lease, as Farmer pointed out it won't be enforceable, you can't change the laws with your lease.

so it is ok for me to accept funds. so i can call the sheriff and tell him not to proceed with eviction. do I need to do or file anything further to show that eviction was stopped?

I would assume that you need to file some sort of motion to stop, or vacate, or whatever, with whatever judicial body ordered the eviction.

So did you get a judgement when you went to court? If you did and that is what they are paying then you can still evict them tomorrow even if they did pay.

Now think about all that you have gone thru with these tennants and trying to collect your rent. Do you really want to go thru all of that again NEXT month?

One more thing, have you read the LL/T laws of your state to see what if any consequences there would be if you do accept the rent.

Btw as soon as you took the money order you technically accepted the payment.
