Heck, if I were the boy's parents, I wouldn't want my grandchild raised by a rapist. If I were the judge, I'd be unlikely to award custody to the rapist. That said,...

Well, when men commit rape, they have to support a resulting child. I'd either award custody to the boy and make the mother pay support, or assess child support against the boy once he has an income, but award the boy the same amount or more as damages for the girl's rape & battery. Net result: girl pays boy more than he pays her. Of course, I'd have to twist the support laws like a pretzel to do it, since family court is separate from civil court.
Regarding charging: A statutory rape conviction will depend on the reletive ages of the parties at the time of the rape. A rape conviction will depend on the girl's use of force/intimidation.
