I am president of our community’s recreation association and we have a pool that we are responsible for maintaining. There has been some debate as to what our liabilities would be if someone were to drown or have an accident at the pool. Our pool is not very big the deepest it goes is 5 feet and that is in the middle of the pool. We are licensed through DHEC, which is our state’s regulatory agency. A 6 ft high fence with a keyless entry system surrounds it. The appropriate signage is in place about no diving and no lifeguard as well as our pool’s rules. If an accident were to happen how liable would our association be? Would a lifeguard make us less liable?
