What is the name of your state? Pennsylvania

The house that I rent has an above ground pool in the back yard. We as tennants are not permitted to use this pool, which is fine, we knew about this when we moved in. The landlord was to have moved the pool, as per her rental advertisement. The pool is still there and the landlord has thus far not committed to moving the pool. She told me that I could drain the water out of the pool, as I complained that it was drawing huge amounts of bugs, and now the landlord is complaining that her pool might collapse because I was only to drain off the water above the "cover", which is a tarp that has sunk into the water left in the pool. Any way to get this person to actually move this pool? The bugs are gross, the mosquitoes are everywhere and I am wondering when we will have ducks in the pool. Aside from giving her 30 days notice that I am moving, do I have any othre options? Thanks in advance.

I would call the health department and explain the situation. Mosquitos are a health risk, especially with a little thing called West Nile Virus in the mix.

Do you have ANYTHING in writing where the landlord agreed to remove the pool?? If so, then simply send her a notice (certified RRR) asking her to remove the pool within a reasonable time (14 days)... and that if she doesn't you will have it removed and stored without recourse.

Your lease gives you the rights as granted therein. Use them.

One caveat though.. you do realize that pissing off your landlord will likely result in your NOT having your lease renewed.

As far as I know there is nothing in writing about her moving the pool. The only thing i have is the original ad that we replied to stating that she would move the pool. Honestly, I don't care if it is there.....however, she said in her ad she would move it. As far as pissing her off and her not renewing the lease, that is her option. She is, however, going to have a hard time finding someone to rent this house with that pool back there drawing bugs and her expecting her tenants to maintain it for her for free. If she would confirm in writing that she is not moving it, then fine, at least she has committed to something, however, right now she is screwing me around. She had no intention of moving it from the get go, it was just put in the ad to get someone to move into the house. If she pisses me off I could make her go through the eviction process I am assuming, which I'd rather not do. I really do like the house, have taken good care of it and have been very cooperative with her. When she comes over I always invite her in and offer to make her tea or give her a soda or something. The fact remains...I did not cover my ass where the pool was concerned and i know there is nothing I can do. I already sent her an email saying I know I cannot force her to move it and I would make the best of the situation. Not much more I can do except move. Lesson Learned:: GET IT IN WRITING....NO ONE'S WORD MEANS ANYTHING IN THIS DAY AND AGE!!! Thanks!

one more thing

She had a really hard time renting this house....took almost 6 months until we came along. I doubt she wants to go through that again. I am willing to cooperate with her andn work with her.....but, she has to be honest. if she is having a problem with moving it, she merely needs to let me know, but ignoring it just doesn't work for me.
