Poor Performance Review Published Company Wide Results in Eventual Termination

What is the name of your state? Colorado

In January 2006 my boss saved an incomplete and unaccurate performance review as the template that all employees in the company used to do the reviews for their subordinates. I was notified by a couple people in the company that my review was saved on the company wide server as the template for all reviews that should have been blank. The review was a very poor refelection on my performance and was not complete because it did not contain my feedback or approval and my boss stated that he had not completed the review. I have no clue how may employees saw or have copies of that review.

I was put on a 90 performance plan to improve my performance. I met all the requirements stated in the performance plan. I was recently terminated because "my skills did not meet the requirements for the new direction of the company objectives." I believe that the incindent with the review harmed my professional reputation and could possibly harm my future professional endevours.

I have done some research on the situation and I have found a case that clearly states that even if it was an accident that this was published on the server this in not a defense that can be agrued. The company offered my a small serverence. I am trying to determine if I have a strong enough case to negotiate a larger severence or possibly file a suit.

Wouldn't the folks who make employment decisions have access to your performance review regardless? I assume that, although incomplete, it was your true review that was later finished and not some grossly incorrect partial review that had no bearing in reality whatsoever.

what are you talking about? If you have all of this 'knowledge' then why are you here asking advice.

Publish here the 'research' you say supports your side of this story.
