My boyfriend was pulled over and charged with possession of meth and possession of marijuana. This is his first time to be charged with a felony. He was also charged with driving under the influence of a controlled substance. He was never tested for this. Can they make the charges stick without any type of test ? What are the chances of him getting jail time for the 2 possessions ? We Live in Alabama. Should we get a lawyer or go for the court appointed? The first day he went to court all the judge said was, you have been bound over to the grandjury, he was not allowed to plea or anything. Please Help !!!!!

DON'T WORRY, JUST RIDE IT OUT. A COURT APPOINTED ATTORNEY WILL NOT TRY TO DEFEND YOU, BUT JUST REPRESENT YOU. NO MATTER WHAT HAPPENS, NEVER TAKE A PLEA BARGAIN BECAUSE THAT MEANS YOUR ADMITTING GUILT AND IF YOUR GOING TO DO THAT MIGHT JUST AS WELL GO THROUGH WITH THE WHOLE TRIAL AND MAKE THEM PROVE YOUR GUILTY. CHANCES ARE, BY THE TIME IT REACHES TRIAL, THEIR 90-DAY EXPIRATION DATE IS UP AND IT GETS DROPPED. BUT ALWAYS REMEMBER THAT ITS THEIR JOB TO PROVE YOU'RE GUILTY SO MAKE THEM DO THEIR JOB AND DON'T TAKE A PLEA BARGAIN. THEY WILL TRY AND SCARE YOU ALOT TOO, BUT ITS JUST A FRONT SO MAYBEY THEY WON'T HAVE TO DO THEIR JOB WITH YOUR CASE.

Wow, I will really put a lot of confidence in an 'advice reply' about legal issues from someone who uses the handle "Druglord" and is so stoned he can't figure out what a 'caps-lock' key is!!!
That one is certainly worth what it cost ($0.00).

In fact, the value of his post is only barely exceeded by that idiot, RenterTroll, who is trying to soften his impending removal by referring to you with your first name (BTW, that is a first... he most have warm memories of someone named Kelly).

So, in trying to correct the worthless posts by others, I offer the following:
Q1) "Can they make the charges stick without any type of test ?"
A1) Test of what?? They did do a test of the siezure and it tested positive. So, the possession (which is by far the more serious) will stand.

Q2) "What are the chances of him getting jail time for the 2 possessions ?"
A2) Depends entirely on the prosecutor, the court, the abilities of his attorney, the evidence and his prior record (if any).

Q3) "Should we get a lawyer or go for the court appointed?"
A3) This is like asking, "Do you want a car that MIGHT get you there (a PD), or one that will PROBABLY get you there (your attorney). If there is anyway that he can afford a private attorney, get him/her. If not, accept the court appointed PD.
