My son received a possesion citation at school. He was in the bathroom with two other students and one had a bag of weed on him. They cited all of them. The boy who had the weed said that all three of them brought a little in and put it in one bag. my son and the other boy deny that they brought the weed to school. My son says he had a text message from the boy that morning stating that he was bringing it to school. The officer said he would tear up the citation if I could come up with the deleted text. I faxed over a notarized statement to my cell phone carrier but it is not going be sent over in one day because of FCC regulations. What will happen when we get the citation.
Good points:
1. I have an email from the principal stating she believes my son did not have the marijuana in his possession.
2. The school secretary tells me my son was with her all morning and would have smelled it (she is willing to put a notarized statement in writing)
3. By the time court comes around, if my son is not lying, The text message will show the other boy brought it with him.
4. He is getting a drug test today (day of the incident) which he doesn't mind (he says)
Bad points. He was in the bathroom with where there was a bag of marijuana.
If the text message shows that the other boy was the one who had it will that help?
