my husband has been with the same company for 20 years and in management for the past 13. Recently there was an opening for a supervisor on second shift. Which is the shift my husband is now facilatator over. The plant manager first told my husband he had the job, and then 12 hours later told him he did not. The position was given to a man with 7 years on the job and only 2 years management experience. My husband is 40 years old and has a good attendence record. My husband had to have back surgery in Dec 2002 and is completely recovered. The plant manager never really gave my husband a good reason for not giving him the job. Isn't there something we can do about this? We are not a union company, but our handbook states that promotions are given based on seniority. yet he was told that management doesn't count. Hope someone can help. My husband is embarassed by this and alot of employees want to know what's going on. Thanks.

There is nothing illegal about this on the surface. It is ONLY illegal if your husband's age played a part in it. If you believe that the ONLY reason he did not get the promotion is that he is 40, you can file a complaint with the EEOC and/or your state discrimination board. Otherwise, you'll have to chalk it up to "unfair but not illegal". Nothing in the law requires them to go by seniority, nothing in the law requires them to follow the handbook, and nothing in the law requires them to give him a reason. (BTW, it is not uncommon for a company to treat managment differently.)
