Possible discrimination?

What is the name of your state (only U.S. law)WV

My question is if a college does not distinguish between undergraduate and graduate students and then the college denies a student the right to an activity based on the fact that they are not in a specified group undergraduate vs graduate. Example I am a graduate student who is enrolled as a full time student I went to the same university as an undergrad I was as an undergrad I was able to use the exercise facilities because I was a full time student I recently tried to go to the same gym and was denied access and told I had to pay a graduate student fee. This fee was never mentioned in the application process. I also was told that when the students take a trip to NYC I would not be allowed as it was only for undergraduate although everything specified a student with a valid school ID. I was also told it was because graduate students weren't required to pay the activity fee, but the funny thing is I have been allowed to participate in several other activities on campus and not been told any different.

Can any one give me any advice on what my course of action should be f anything.

You are definitely being discriminated against.

However, it is not an ILLEGAL discrimination.

I would talk to the dean of student affairs... but that is as far as you can go.

To be illegal discrimination, discrimination needs to be on the basis of specific protected classes (sex, religion, national origin, etc).

Any non-named type of basis for discrimination is legal.

We all discriminate every day... we choose to wear a red shirt rather than a blue or to eat at this diner or that.

A class of student is not a protected class and, therefore, it is perfectly legal to discriminate on that basis.

Graduate versus undergraduate students DO pay different fees, and are therefore allowed different access to facilities and activities. For example, undergrads at ny university may use the recreation facilities at no charge - but they really HAVE been charged, because they pay a fee that is lumped into their tuition. Grad students have to pay an out of pocket fee, because it is not in their tuition, and most grad students are adults who do not live on campus and therefore wouldn't use the rec.

You also say that you HAVE participated in several activities on campus - consider that a bonus, and if you keep complaining, one that will be taken from you.
