Possible Harassment??

After reading over a few threads, I think I may have a case not only for myself, but others as well.

My supervisor is very verbally abusive to a few of my co-workers, as well as having a retaliatory attitude towards those who do scare easily. On more than one occassion, he has told me personally that someone upset him, and in response to that he would change their schedule to get back at them for pissing him off.

We have a day shift and night shift here, so most everyone on those shifts are where they want to be. There was an instance where a co worker and close friend of mine was asking to leave because his mother was rushed to the hospital after having a major stroke. He's the one that is listed as her emergency contact, so when he got that phone call, naturally he needed to leave.

Prior to that situation, my friend had gone to the HR department and made a complaint on my supervisor, so there were hard feelings there. My friend contacted him several times asking him to leave, and my supervisor kept telling him no...we didn't have the man power, which in fact we did. If we had fallen short, he could've stepped in and helped too, especially since its part of his job description to do so.

I was in my supervisors office talking to him, and he mentioned that my friend had been repeatedly calling him, and he pissed him off. He kept stating, "I'll put that SOB on nights for calling me for a favor after going to HR." He was also saying that, "I know he has a family and kids, I'll fix his schedule to make sure he never sees them."

I had a complaint about him once because we have scheduled lunch breaks. I was not ready to go at my scheduled time, and another guy who was scheduled to go later was ready to go...so we wanted to switch. He kept up with this "no switching' deal, and I told him that I wasn't ready to go, yada yada. He responded saying that he doesn't care, and we cannot switch lunch hours. Well, I was not satisfied with his response and felt that he was being unreasonable, so I took it up wit my manager using my chain of command. I explained to him the situation, and we came to an understanding...although he did not agree to overrinding his decision, he did say that he was being unreasonable, but it would be of bad taste to override him like that. He did however state that he would talk to him about relaxing a little bit on that issue.

Our quarterly evaluations came about last week and I was told that my bonus was lower than normal because I circumvented his authority by going to my manager about the above issue. I explained my side, and told him that I used the proper chain of command when went about this, so I didn't see a problem. We kept tapping on the issue, and then he told me that if I ever went to HR or above his head after he gave me a direct order, he would put me on nights.

Is there an issue here? He has 18 people working under him, and all 18 have at one time or another filed a complaint or grievance with the HR department on him. My manager can be very creative in how he protects him because my supervisor is a "yes man" for him. I along with the rest of the crew would like to see some change brought about in our dept. but it doesn't seem like ther is going to be anything done about it.What is the name of your state?

The only issue is for you to find another job, the manager and supervisor are obviously idiots, but thats not illegal.

Then take that up with either HR or upper management, but don't be surprised if you find yourself in the bread line. Unless you are being harassed for your gender, race, religion, age, etc... then it is not illegal
