A false claim was made that I violated an OP. This led to my arrest without any evidence that I had actually violated said OP. After my arrest a search warrant was executed and that led to more charges. Was this done illegally?

For a search warrant to be issued, a judge believed grounds existed to support its issuance or there was probable cause to believe that grounds existed.

Your attorney will review your arrest over the reported protection-order violation, and your attorney will review the grounds given for the search warrant, and your attorney will review the search that was conducted.

If there were any irregularities or illegalities involved with your arrest and the subsequent search, your attorney should be able to recognize these and perhaps use what s/he finds to help with your defense.

The more you say to people in person or online about your arrest and the search, the greater the risk of you saying something that damages your defense. Speak only to your attorney.

The evidence they have is that you were reported as violating the OP. With an OP, they tend to err on the side of caution when a violation is reported.

The search was probably legal. Why do you believe otherwise? We don't need (or want!) the details, but your lawyer does.

Let's back this up. I assume that, at some point in the past, someone obtained an order of protection/restraining order against you? Correct? If so, for what reason and when was this order obtained? What is/was your relationship to the person who obtained it?

Then, recently, the person who obtained the order claimed that you violated it. What exactly did this person claim, and what is your basis for claiming it was false? The claim was made to law enforcement, correct?

What does "without any evidence" mean? The other person's claim is evidence.

Where was the warrant executed? Your home? What was discovered as a result of the search? What other charges have been filed?


Was this done illegally?

Doubtful, but there's no way to know for sure without more information.

Any additional information on the protection order and your arrest is best told to an attorney in your area who can treat the information with a confidentiality that those on a public forum cannot. Anything you say to us here potentially can be used against you.

Say nothing to anyone but your attorney.
