Possible Wrongful/Forced Termination?

I was working for a wireless company for 4 years. I had a perfect track record, and was a model manager (store manager of a high volume store). 2 months ago, an employee came to me informing me someone was doing drugs in the bathroom. I hestitated, but called my boss to report what I had found out.

Several weeks later, Corporate Security came into my store and starting questioning every employee, including myself. In addition, they began going through our text messages, as we don't pay for our service. (They have the right, since it is considered their property.)

My assistant manager was leaving to go to a different store. He wanted to go out with me and a few fellow employees. After a few hours, we ended up at a strip club, where I stayed away from the floor, and my employees (as far away as I could), since that atmosphere was not for me. I couldn't leave, since I didn't drive.

Back to the drug portion. Apparently, several employees in my store (which I had just been moved into - less than 2 months) did drugs while on the job. Corporate Security basically told me that nobody did drugs until I showed up. (Implying that the previous manager also knew nothing about people using drugs.... it started when I got there.) My thought process was that I was still getting to know these people, there werent any signs of drug use, and for that fact, I was never given training as a manager to look for drug use signs.

Back to the night out. The next day, a female employee apparently called CS and filed a sexual harrassment claim against me. I never touched her at all, however, SHE was having the strippers come over to her, etc., and even pulled her shirt up and bra, spinning around for all to see. however, I never touched her. She claims I did. (There is no proof, other than her word.)

After the investigations were completed, my boss came into the store, and began firing the people that admitted to doing drugs. He came over to me, and told me that "Now would be a good time to think about other opportunities elsewhere". That made me think that indeed I was going to be terminated, so I wrote a resignation letter, and resigned.

At no point in time did he tell me what the outcome of the investigation would be. However, the quote above led me to think that I was going to be fired. Now, 2 months later, after being on several job interviews, submitting my resume to about 20 companies, I find out that when a potential employer is calling my old job, they are being told that I "Resigned while under company investigation.". There are several things that bother me about this situation:

1) Who would believe that NOBODY EVER did drugs in a location prior to me being there. Especially when people admitted doing drugs there prior to me (That was told to CS). The manager that was there before me didn't get in any trouble at all.
2) What training did I ever recieve about drug use and finding the signs? None.
3) The assistant manager that went out with me to the strip club, and was closer to the female employee that stipped, did not get in any trouble. He is management as well.
4) The text messages revealed that the female employee called in several times because she was high or hung-over, and that she too did drugs while at work. Nothing happened to her.
5) The investigations were over. When my boss made that statement, then an outcome had already been reached by the company. How can I be coded as "Resigned while under company investigation", when the investigation was clearly over? It should read that I simply resigned.

Now, I cannot get a job because I left while under investigation. My resume is impeccable, and have the backing and support of all I worked with, except my former boss and HR...

Well, you should know better than anyone that over the phone an exemployer can only say that you worked there. Even eith a release from you, as a Retail Store Manager I still was always instructed that I can only verify former employment. You did cross the line when you went out with other employees especially to a strip club and if the company didn't have a policy against it, why would you ever want to have your employees know anything personal about you. I would say to call the HR department of your former employeer and tell them that more information is being supplied when trying to verify your previous employment and that if it continues then you will have to take further action, or maybe you can just use the Asst. Manager as a contact person for the company and since you were close maybe he won't throw you under the buss.

Lost in NC, you are wrong. There is no law in any state that limits an employer (on the phone or otherwise) to the limits you suggest. Many companies have such a policy but it is NOT law anywhere in the US, despite a pervasive myth to the contrary.

Barring a bona fide contract that specifically states otherwise, an employer may provide any information that is true, that they honestly believe is true, or that represents their honest and supportable opinion.

In this case, the poster DID quit while under investigation. That is the truth. There is no law anywhere in the US that prohibits the employer from telling the truth.

And not that I'm saying the OP is "stretching the truth", but why do the majority of folks here who think they were wrongfully terminated describe themselves as "model employees"? Nobody's perfect, boys and girls. :rolleyes:
