possiblility of moving out of state

I have been dating my current boyfriend off and on (more on than off) for over a year. He just got found out that he his job will be transfering him to Phoenix. My question is he wants me and my daughter to go. My duaghters father has had many, many chances to bond with his daughter and chooses other things and people infront of her. (she is always on the back burner). Would I be selfish to move her away. She knows my boyfriend and has a closer relationship with him then her own father. Her father is not on the birth cert. and we have never been to court. He does not pay child support.

One more thing, since he is not on any documentation do I have to give him 30 days notice if I was to move?

I am afraid that he will try to stir up trouble for us. He is a very big control freek.

Do not attempt to convince us that he is a bad person for you have to make the decision on what is best for your children. You have pointed all of the faults of this person out but not his good points. Why would you want to be with someone that was so bad??? oh yeah, "I did not know he was this way until after I had children for him."

Well I would think the correct thing to do is inform him 45 days ahead of time about what you are doing. Since there is not any documentation on the father being the father he would have to go through the process in making that determination. You can leave the State however, if he does argue the situation it will probably be heard in NM, unless you establish residency in AZ which takes 6 months.

You would also have one more good thing going for you. The courts in NM are very mother sided.

I am not going to say anything bad about my ex he is what he is. And very sneaky at that. As far as saying good things there is none. He is never there for my daughter, emotional, physically, spirtiually, and defently not financially. He is a drug user, maker, dist., has a bad temper. Even his own family mother father etc. dont want him around her and he never has been alone with her cause they never have bonded. He has seen her maybe 5 time and she is going to be two very soon.

I could go on but I am really not looking to cut him out of his life I just want her and I to be happy, and be legal about it too. No need to bite my head off. Thanks for your advise, even if it was harsh.
 
Truth be known until your childs 18th b-day bio dad can enforce his rights to visitation, shy of any termination proceedings so listen to the other poster and get this taken care of before it bites you in the butt plus you can get child support or at least a judgement if he ever does have $$$.

If paternity has never been established and there is NO COURT ORDER then you can move to africa if you please because legally he is nothing to this child. You do not have to give notice of your move at all. So if you feel that it is in your childs best interest then move away. I am not saying if I agree or not I dont know the situation if it is best for this child to be or not to be around this child but legally you dont have to tell the dad anything
