If we draw up a form for a promissory note and for a Property agreement (both of us writing off claim to each other's homes) and witnessed by our marriage counselor (or other professional), would this stand up in court? The promissory note is for 15k (he really owes me about 20k).

We're separated (but PA doesn't recognize separation) and hubby wants to continue marriage counseling, whereas I don't unless these are agreed to. My previous threads are pretty specific if someone wants to read the history for this. 18 month marriage, total of 6 months counseling, he moved out 6 times so far....and I don't want him moving back in at least at this point.

You really want to have an attorney sort this out. For starters, do NOT give up your rights to the other house unless your name is off the mortgage. The same thing applies to stbx.

This forum is full of people who made mistakes of that sort and lived to regret it. When you consider the consequences, good attorneys aren't that expensive (and may even be cheap).

Bethy, I just read through almost all of your previous threads (only skimmed some of them). you really need to file for divorce and get sole possession of your house, close that joint checking account, and then figure out if you want to continue counseling and a relationship with this person. but if it were me, i would file for divorce and get that ball rolling, if you happen to reconcile after divorce you can always remarry or just be a couple. however, either way, i would keep all finances and ownership of everything completely separate!

My daughter is doing much better - thank you for asking. They took her off 2 meds and she can think/reason a lot clearer. She's off to stay on campus in Sept. (commuted) and I think she's finally ready. :)
