In some Agreements/Contracts, I see a sentence that says "one is entitled
to seek for immediate injunctive relief or any other equitable relief without
posting a bond, and without necessity of showing actual monetary
damages." , and some that says "one needs to post a certain bond"
My question is:
(1) Why can one seek for injunctive relief without a bond? I thought
that one is obligated to do so.
(2) If it differs between the states, which state doesn't require a bond
to seek injunctive releif?
(3) What difference will it make to either party (i.e. the party seeking
for injunctive relief and the opponent party)?
(4) What is the risk for both party to put or not to put this sentence
in the Agreements/Contracts?
