I want to set up a website to expose a business for unfair practices. I purchased a front bay window, ordered 3 basement windows and contracted for some repairs to the vinyl on my house. Verbal contract. Handshake. He had done work for my mother, my sister and a friend who I referred him to.

The cost of the front window was $3050.00. 3 basement windows $1800.00. The rest was for the repairs to the vinyl. I gave the salesperson a deposit of $1290.00 when the front window was installed. Two weeks later a check for $4500.00 in full payment of all goods and services agreed upon. I no longer want the 3 basement windows nor the repairs done to the vinyl. I have cancelled checks proving I paid $5700.00. He admits he did not deliver or install the 3 remaining windows or do the remaining work. He will not refund my money. He is in fact telling the BBB that I owe HIM money. :mad: BBB is saying that unless I can produce a contract, they cannot proceed. :mad: I sent them the cancelled checks. The deposit check of $1290.00 with front window written in the memo section of the check. :confused:

If I stick to the facts, is it illegal for me to advertise what my experience with this company has been to help others avoid the hell of dealing with this business?

Thank you for your help... I am getting desperate because it seems like there is nothing I can do to get my money back! :(

Go ahead and post your childish website. And be sued.

You have no contract. And the BBB has no authority to do anything.

If you THINK you have a contract, the sue him.

You can certainly create your website....
However, the other party can, and likely WILL, sue you over your claims. As long as your post is true and accurate, you can use that as your defense.... AFTER you spend a few thousand dollars in legal fees and costs.

If you feel you have 'been done wrong'... sue him in small claims court.

This contractor was a family friend. A handshake and his word was good enough for me at the time. I was silly to trust him. I do not have thousands of dollars to "donate" to scammers and thugs.

As for the first responder, CHILDISH website? Grow up.

I spent time last night reading questions and responses. I was hoping you would not take an interest in my post because frankly, I am not interested in being a however momentary victim of your venting at the expense of people who come here for help. Period.

If you are here to help people, then right on! I admire that. I'm sure everyone does.

My free professional and unsolicited advice to you? Don't respond if you cannot do so without the snide remarks and attacks on people who reach out to you for understanding and help. Your responses are like being wronged all over again. It is unattractive and sadistic. NOT cool. :eek:

Actually, the BBB decided in my favor WITHOUT a written contract. He left a very incriminating voice mail admitting he owed me windows. Denied ever getting the deposit check which is cashed and signed by him back in July with a memo notation "deposit front window". The cancelled checks and the numbers the contractor was putting forth did not add up.

Thats what happens when you are a liar. You get caught.

I thank those who have taken the time to give my problem serious thought. For those of you who have thought of it as trivial, childish and a joke? I feel sorry for you.
