What is the name of your state (only U.S. law)? WI
The owner of a rental property next to my home has accused me of damaging the rental property. I have been investigated by the police, the insurance co. and had a survey done. The owner of the rental property has been shown prof that one of the claims made did not involve the rental property (a different homeowner did work on his own property and I was investigated for property damage to the rental property and I removed trees from my property and the rental owner caimes I removed them from the rental property). It has been proven that there was no property damage. Several videos of me or making reference to me have been posted on youtube. The caption stated my name and where I live and that I am being allowed to damage the property. The video shows the owner of the rental harassing me on my own property and telling me I do not own parts of my land and me saying to stop harassing me and stay off my land. Nothing about property damage except for the caption. I am reporting this to police but am I able to stop this and is this libel because the rental owner has been shown I did not damage the property.

Geez. These are some YouTube videos that are sure to get a lot of hits. ;)

Without seeing the videos, it is hard to say if you have any legitimate cause of action. It doesn't sound that way, however, based on what you have posted here.

If you wish to pursue the matter, have an attorney in your area take a look at what has been posted online about you and go from there. You may also wish to look for another place to live.

Good luck.

There are 8 videos that make reference to me the last one stated I have committed a crime that has been proven untrue. one video has had 8,000 hits. I would like to move but can not at this time.

About the moving comment I made, blocked, I am sorry. I read through your first post rather rapidly and got the impression from it that you were living in a rental house, which would make your moving more of an option. After re-reading what you wrote, I understand now that you own your house and it is the neighboring property that is rental property.

Even so, based on a review of your posting history, moving still seems like a desirable option, should it ever become a realistic one for you. ;) :)

As for the videos, it is impossible for me to tell you, from this distance and without the benefit of seeing what exactly is on the videos, if there is any legitimate action you can pursue against the rental property owner. I think it unlikely that you have enough to support a defamation suit based on what you have posted here or, at least, have a suit that would be worth the financial costs of pursuing.

The costs that must be incurred with a defamation claim can often be quite high while damages awarded can often be minimal (this assuming you prevail in an action, and there is never a guarantee of that).

I can understand your frustration with the landlord, who seems intent on harassing you for all sorts of reasons but I do not see a defamation action as the reasonable or best solution to this harassment.

But have an attorney in your area personally review the videos, and all of the facts that led to the publication of the videos on YouTube, to see if his assessment of the matter differs from mine.

Good luck.

The owner of the rental property has started a new youtube. this one has 4 videos and very detailed descriptions of the "crimes" I have committed. She has been given the documents that show her clam can not be true. The videos show her harassing me while I am in my yard and the area in the video she claims I damaged is my property. The amount of damage she claims would make it a felony.

I suggest you have an attorney in your area look at the videos to determine their defamatory character.

Perhaps the attorney you see can draft a cease and desist letter and send it to the owner of the rental property, advising the property owner that you are considering taking legal action against her if she does not immediately remove the videos from their locations online and if she doesn't stop making false and defamatory statements about you.

The threat of a lawsuit, delivered by an attorney to the property owner by way of a cease and desist letter, may be enough to resolve the matter and get the videos removed.

Defamation actions are notoriously expensive to pursue. If, however, your reputation has been injured by the false claims of criminal activity to the extent that an award of damages seems likely (and enough to cover the costs of the suit itself), and the attorney you consult believes all other elements necessary for a successful suit can be met, this could be something to consider.

Again, however, you need a personal review of the videos to tell if what has been posted can support a lawsuit.

Good luck.
